Terms and Conditions of Sale – disarrayclth.com

§ 1 Preliminary Provisions

  1. These Terms and Conditions set out the rules for using the Store.

  2. The information presented in the Store constitutes an invitation for Buyers to submit offers to the Seller for concluding a sales contract for the goods presented in the Store. They do not constitute an offer within the meaning of the Civil Code.

  3. To use the Store, a device with the latest version of an internet browser supporting cookies and JavaScript with internet access is required.


§ 2 Definitions

  1. Business Days – Monday through Friday, excluding public holidays.

  2. User Account – a free feature of the Store (service) allowing the Buyer to create an individual account in the Store.

  3. Buyer – any entity placing an Order through the Store.

  4. Terms and Conditions – these terms and conditions.

  5. Store – the online store operated by the Seller at disarrayclth.com.

  6. Seller – PROJECT NO FEAR S.C., registered at: Niepodległości 15/57, Częstochowa 42-216, Poland. NIP: 9492254098, REGON: 521505188, owner of disarrayclth.com.

  7. Order – an offer to conclude a sales contract for a product presented on the Store’s website, including at minimum: product specification, price, and delivery cost (PLN 15 for parcel locker, PLN 16 for courier).

§ 4 Placing Orders

  1. The Buyer places an Order with the Seller via the Store.

  2. To place an Order, add the desired product to the cart and select applicable parameters (e.g., size).

  3. The Buyer then selects the delivery method, payment type, and provides personal data (including delivery address).

  4. The Order is placed upon confirmation by the Buyer and acceptance of the Terms and Conditions.

  5. The sales contract is concluded when the Seller accepts the Order.

  6. Order acceptance is confirmed via email to the address provided in the User Account or order form.

  7. Acceptance with modifications is considered a new offer and requires the Buyer's acceptance.

  8. The Seller will promptly respond to the Order.

  9. The Seller will provide confirmation of the contract on a durable medium, at the latest upon delivery.

  10. Orders can be placed using a User Account or without one via a one-time form.

  11. The Seller reserves the right to reject orders, limit payment methods, or require prepayment if there are justified doubts about the authenticity or reliability of the provided data or payment.


§ 5 Order Cost

  1. Prices shown include VAT.

  2. The total cost includes product price and delivery costs displayed in the cart.

Delivery Costs:

  • Parcel locker (InPost): PLN 16.00

  • Courier: PLN 17.00


§ 6 Payments

  1. The Buyer may pay for the Order via:

    a) Bank transfer: 11 1050 1142 1000 0092 9511 5704
    b) Payment platforms: iMoje / Przelewy24 or Shopify Payments

  2. For advance payments, payment must be made within 5 business days from the conclusion of the contract.


§ 7 Order Fulfillment

  1. In Poland, delivery is via courier or parcel locker (InPost). International delivery is via Poczta Polska.

Delivery time includes preparation and shipping, not exceeding:

a) Courier: 4 business days
b) Parcel locker: 5 business days
c) Poczta Polska: 14 business days

  1. The order fulfillment period starts from the sales contract date, unless otherwise stated.

  2. Business days apply to product preparation and shipment.

  3. Delivery time is specified individually per product on the website. Orders with multiple items are shipped after complete fulfillment.

  4. For prepayment, processing starts upon receipt of payment.

  5. The Seller must deliver goods free from defects.


§ 8 Right of Withdrawal

  1. Consumers have the right to withdraw from the sales contract within 14 days without giving any reason.

  2. The withdrawal period expires 14 days from the day:

    a) the Consumer receives the goods; or
    b) in the case of multiple items delivered separately, the day the Consumer receives the last item.

  3. The Buyer may cancel the Order until it is dispatched.

  4. To cancel, the Buyer must inform the Seller via phone or email.

  5. In case of prepayment, a refund will be issued within 7 business days, depending on the method.

  6. To meet the withdrawal deadline, send the statement before the 14-day period ends.

  7. In case of withdrawal, the Seller refunds all received payments, including standard delivery costs, within 14 days of receiving the withdrawal notice.

  8. Refunds are made using the original payment method unless the Consumer agrees otherwise.

  9. The Seller may withhold the refund until goods are received or proof of return is provided.

  10. Goods should be returned without delay, within 14 days of withdrawal notice.

  11. The Consumer bears the return shipping cost.

  12. The Consumer is responsible for any diminished value due to handling beyond what is necessary to determine the product’s nature and characteristics.

  13. If the Consumer withdraws before the Order is accepted, the Order is not binding.


§ 9 Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to contracts:

a) for non-prefabricated items made to the Consumer’s specifications;

b) for sealed items not suitable for return due to hygiene reasons if opened;

c) for items inseparably mixed with others after delivery;

d) for sealed audio/video recordings or software unsealed after delivery;

e) for digital content not on a physical medium if the service began with Consumer’s consent before the withdrawal period ended.


§ 10 Complaints

  1. In case of product defects, the Buyer may file a complaint under the warranty as per the Civil Code (with certain limitations for Entrepreneurs).

Consumers may:

a) demand a price reduction,
b) withdraw from the contract for a major defect,
c) demand replacement,
d) demand repair.

  1. For Entrepreneurs, warranty claims are valid if a defect is reported within 6 months.

  2. Entrepreneurs are not entitled to withdraw, reduce price, or request repair.

  3. Complaints can be submitted electronically or in writing to the address in § 3.

  4. Consumers must return defective products at the Seller's expense if necessary.

  5. Recommended complaint content: Buyer details, defect description, date of detection, and desired resolution.

  6. Recommendations are non-binding for Consumers and do not affect their rights.

  7. Technical complaints about the Store should be sent to the email in § 3.

The Seller will respond within 14 days.


§ 11 Out-of-Court Dispute Resolution

Consumers may use:

a) Mediation via the Provincial Inspectorates of Trade Inspection;
b) Permanent Consumer Arbitration Courts;
c) Online Dispute Resolution (ODR) platform: http://ec.europa.eu/consumers/odr/


§ 12 Personal Data

  1. The Seller is the administrator of Buyers’ personal data.

  2. Data is provided voluntarily but is required to complete Orders and services (User Account).

  3. Data is processed for contract performance under GDPR.

§ 13 Final Provisions

  1. The sales contract based on these Terms is concluded for a specific Order only.

  2. The Buyer is prohibited from providing unlawful content.

  3. Contracts are concluded in Polish.
