Personal Data Processing

PROJECT NO FEAR S.C processes personal data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR”). For the operation of the website DISARRAYCLTH.COM, through which Users can make purchases (hereinafter referred to as the “Service”), appropriate technical measures are implemented to ensure the protection of processed personal data and to safeguard such data against unauthorized access, capture by unauthorized persons, unlawful processing, as well as alteration, loss, or destruction.

You have the right to contact us at any time to obtain:

  1. information about whether your data is being processed, and other details, including any data protection breach;

  2. access to your data;

  3. rectification of your data;

  4. erasure of your data (“right to be forgotten”);

  5. restriction of processing;

  6. data portability;

  7. objection to data processing, under Article 21 of the GDPR;

  8. not to be subject to a decision based solely on automated processing, including profiling.

Niepodległości 15/57, registered under NIP: 9492254098, REGON: 521505188, email: info@disarrayclth.com, hereinafter referred to as “DISARRAY” or “Administrator.” Data processing includes all operations performed on User data, including storage or analysis for the purpose of services on disarrayclth.com. User data will not be sold to third parties, in particular will not be shared for third-party marketing.

Purposes of Processing

DISARRAY processes Users' personal data in order to fulfill orders placed via the Service owned by the Administrator, as well as for contact regarding orders placed or initiated, account registration and execution of the sales agreement (purchase), based on Art. 6(1)(b) of the GDPR, and to meet legal and tax obligations based on Art. 6(1)(c) of the GDPR. Data may also be processed under the legitimate interest of the Administrator (Art. 6(1)(f)), e.g., for legal claims or direct marketing. Data submission is voluntary but necessary to create a user account and make a purchase.

Newsletter

The newsletter is only available to persons over the age of 16. By subscribing, the User declares that they are over 16 and capable of giving such consent. The data is processed to send marketing communications about the Administrator’s products and promotions based on Art. 6(1)(a) GDPR. Submission is voluntary but required to receive the newsletter.

Contractors

Data is used for executing contracts entered into by the Administrator, based on Art. 6(1)(b) GDPR, for fulfilling legal/tax obligations under Art. 6(1)(c), and under legitimate interest (Art. 6(1)(f)), such as communication with persons mentioned in the contracts who are not parties to them. Data may also be used for direct marketing under legitimate interest, with the right to object to such use.

In court, enforcement, or legal proceedings, the personal data of other participants may be processed under the legitimate interest of the Administrator (Art. 6(1)(f)) for the purpose of legal claims or defense.

If you consent, we also process your data for analytical purposes using Google Analytics.

Data Sharing

Your data may be shared for contract execution, service provision, delivery, payment processing, data analysis, and marketing/customer service with entities such as: postal and courier services, banks and payment providers, legal and accounting service providers, and other entities entrusted with data processing under Articles 28 and 29 of the GDPR.

Data Retention Period

The retention period depends on the type and purpose of data.

Data is processed either:
(i) for the period defined by law; or
(ii) until the purpose no longer applies.
For example, order data will be kept as long as legally required and then deleted once the purpose expires.

Newsletter

Data is retained until consent is withdrawn and newsletter subscription is canceled, with processing extended for up to 30 days after request.

User Account

Data is stored until the account deletion request is made, plus a maximum of 30 days to process the request. Some data may be retained for the statute of limitations for potential legal claims.

Marketing

Marketing data, including profiling, is processed until an objection is raised.

Your Rights

According to the GDPR, you have the right to:

  • access and receive a copy of your data;

  • rectify your data if inaccurate or outdated, and erase it where processing is not legally required;

  • restrict data processing;

  • object to processing based on legitimate interest, including profiling;

  • object to processing for direct marketing purposes;

  • withdraw consent if processing is based on consent (this will not affect past lawful processing);

  • data portability;
